However, the data provided by Collins WordBanks Online (WBO) cannot be reused. In each csv file of Dataset 1, these are presented in Columns B to D (called “Pre-node”, “Node” and “Post-node”), whereas in the csv files of Dataset 2 they are presented in Columns B to D (called “left”, “kwic” and “right”). The contents of these columns are extracts from Collins WordBanks Online (WBO), distributed by HarperCollins. These extracts are available under the terms of use described here: https://blog.collinsdictionary.com/wordbanksonline-terms-and-conditions-of-use/. On their webpage (https://corporate.harpercollins.co.uk/reporting/permissions/), HarperCollins UK/HarperCollins Publishers Ltd refer to UK Copyright Law for exceptions where a limited amount of material may be used without permission of the copyright owner. We believe that the use of the extracts referred to above is licensed under the fair dealings provision of UK Copyright Law. According to UK Copyright Law (cf. https://www.gov.uk/guidance/exceptions-to-copyright#fair-dealing), “[f]actors that have been identified by the courts as relevant in determining whether a particular dealing with a work is fair include: does using the work affect the market for the original work? If a use of a work acts as a substitute for it, causing the owner to lose revenue, then it is not likely to be fair; is the amount of the work taken reasonable and appropriate? Was it necessary to use the amount that was taken? Usually only part of a work may be used” The extracts used in this present dataset may be said to represent fair dealing according to both these factors: The extracted material does not affect the market for the original work, as it is unlikely that any researcher would refrain from using Collins WordBanks Online because of the availability of the extracted material contained in the present dataset. The amount of the extracted work is reasonable and appropriate as it was necessary to carry out the study, and as it is necessary to replicate the study. Also, the extracted material does not represent more than brief citations (single sentences, for example) from the corpus, and thus does not infringe the copyright of the original IPR holders." @default.
